Terms and Conditions for the Cherry Tree Adoption Programme

Welcome to the Cherry Tree Adoption Programme at Forest Lodge Orchard. This programme allows participants to adopt a virtual twin of a cherry tree from our orchard, creating a symbolic connection to our farming experience. Please read these terms and conditions carefully, as they govern your participation in the programme.

1. General Overview

By joining the Cherry Tree Adoption Programme, you agree to the following terms and conditions. This programme is designed to offer participants a symbolic connection to a cherry tree at Forest Lodge Orchard through the adoption of a virtual twin of a cherry tree. This adoption is purely symbolic and does not confer any actual ownership or rights over the physical tree or any other property of Forest Lodge Orchard.

2. Adoption Rights and Obligations

  • Symbolic Ownership: The adoption of a virtual cherry tree is symbolic. It does not confer any legal ownership, rights, or title over the actual tree, land, or any other assets of Forest Lodge Orchard.
  • Virtual Twin: Participants will receive updates and information about the adopted tree, including photos and details of its growth and development.
  • Adoption Duration: The adoption is valid for selects harvest season chosen.

3. Cherry Entitlement

  • Harvest Yield: Each adopted tree entitles the participant to receive up to 6 kg of cherries per harvest season, depending on the actual yield of the tree. The cherries will be selected based on quality, ensuring that participants receive the best produce available from their adopted tree.
  • Delivery of Cherries: Cherries will be delivered when they are at their best, and specific delivery dates cannot be guaranteed. Deliveries will be made to the registered address on the user profile. Participants will be notified 48 hours before shipment. If you need to amend the delivery address, please log in to your profile or contact us at cherries@forestlodge.nz. Delivery is only available to New Zealand main island non rural addresses.
  • Harvest Variability: The amount of cherries received may vary based on factors such as tree health, seasonal conditions, and other variables affecting the yield.

4. Weather Events and Harvest Loss

  • Extreme Weather Conditions: Participants acknowledge that agriculture is subject to natural factors that are beyond human control. In the event of extreme weather conditions, such as droughts, floods, storms, or other natural disasters, that adversely impact the harvest, participants may receive fewer cherries or no cherries at all.
  • No Compensation Clause: In cases of extreme weather events or other circumstances leading to a loss in harvest, participants are not entitled to any compensation, refund, or replacement for the cherries not received. This clause includes any loss due to pests, diseases, or other agricultural challenges.

5. Communication and Updates

  • Regular Updates: Forest Lodge Orchard will provide regular updates on the status of the adopted tree, including growth progress, expected harvest times, and any relevant news about the orchard.
  • Communication Channels: Updates will be communicated through email, newsletters, or other specified channels. Participants are responsible for providing accurate contact information and ensuring they can receive communications.

6. No Legal Ownership or Claims

  • Symbolic Nature of Programme: The adoption of a virtual tree does not provide any legal claim or ownership over Forest Lodge Orchard or its physical or intellectual property. Participants cannot claim any profits, produce, or rights other than those explicitly stated in these terms and conditions.
  • No Transfer of Rights: Adoption rights are personal and cannot be transferred, sold, or assigned to any third party.

7. Programme Changes and Termination

  • Right to Modify: Forest Lodge Orchard reserves the right to modify, suspend, or terminate the Cherry Tree Adoption Programme at any time without prior notice. Participants will be informed of any significant changes to the programme.
  • Refund Policy: In the event of programme termination, refunds will be issued to participants for the unused portion of their adoption period. Refunds will be processed promptly, and participants will receive their entitled benefits until the end of the current season, subject to availability.

8. Liability

  • Limitation of Liability: Forest Lodge Orchard is not liable for any direct, indirect, incidental, or consequential damages arising from participation in the Cherry Tree Adoption Programme, including but not limited to the loss of expected cherries, emotional distress, or other damages.
  • Indemnification: Participants agree to indemnify and hold Forest Lodge Orchard harmless from any claims, losses, liabilities, or expenses arising from their participation in the programme.

9. Privacy and Data Protection

  • Data Use: By participating in the programme, participants consent to the collection, use, and processing of their personal data for the purposes of administering the programme, providing updates, and delivering cherries.
  • Privacy Policy: Forest Lodge Orchard will handle all personal data in accordance with the New Zealand Privacy Act. Personal information will not be shared with third parties without participant consent, except as required by law.
